Terms of Service

These Terms of Service ("Terms") govern your use of the tunnelto tunnel proxy service at tunnelto.me and associated client software (the "Service") operated by tunnelto ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms.

1. Intended Use

The Service is intended for development, testing, and demonstration purposes only. It is not designed, warranted, or supported for production workloads, mission-critical systems, or applications where downtime or data loss could cause significant harm. You use the Service for production purposes entirely at your own risk.

We make no guarantees regarding uptime, latency, throughput, or availability. The Service may be interrupted at any time for maintenance, upgrades, or other operational reasons without prior notice.

2. Account Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials, API tokens, and SSH keys. You are responsible for all activity that occurs under your account.

By creating an account, you consent to receive emails from us related to the operation of your account and the Service, including: account and security notifications, billing confirmations, onboarding and setup guidance, usage tips, reminders about pending actions (e.g. unverified domains), and occasional product updates or offers related to the Service. You may opt out of non-essential emails at any time by clicking the unsubscribe link included in any non-transactional email, or by contacting privacy@tunnelto.me.

We reserve the right to determine, at our sole discretion, whether any use of the Service violates these Terms.

4. Domain Names

When you register a subdomain on tunnelto.me or configure a custom domain, you represent that you have the right to use that domain name and that it does not infringe on any third-party rights. We may reject, disable, or remove domain names that we determine, at our sole discretion, to be misleading, infringing, or otherwise inappropriate. Domain names that impersonate or create confusion with established brands, services, or government entities are strictly prohibited.

5. Account Suspension and Termination

We reserve the right to suspend, restrict, or terminate your account at any time, at our sole discretion, with or without notice, for any reason, including but not limited to:

In the event of termination for cause, you are not entitled to any refund of prepaid fees. We may delete your account data, tunnel configurations, and associated resources upon termination.

6. Subscription Plans and Payment

Paid plans are billed monthly through Stripe. By subscribing, you authorize recurring charges to your payment method. You may cancel your subscription at any time through the billing portal; cancellation takes effect at the end of the current billing period. We do not offer refunds for partial billing periods.

We reserve the right to change pricing at any time. Price changes for existing subscribers will take effect at the start of the next billing cycle after 30 days' notice.

If you exceed your plan's included bandwidth, overage charges will be applied at the rate specified for your plan. Free and Hobbyist plans have hard bandwidth caps with no overage option.

7. Your Content and Tunneled Traffic

You are solely responsible for all content, data, and traffic that passes through your tunnels. We do not monitor, review, or assume any responsibility for the content of your tunneled traffic. You represent and warrant that your use of the Service complies with all applicable laws and does not infringe any third-party rights.

8. Upstream Targets

The Service lets you configure a tunnel to forward to any host and port reachable from the machine running the tunnelto client. This flexibility exists so you can expose a local dev server, a Raspberry Pi on your home network, a container on a Docker host, or any other service you own or operate.

You may only configure a tunnel to forward to services that you own, operate, or are explicitly authorized to expose. You may not use the Service to proxy traffic to third-party public services, to impersonate them, to serve their content from a domain you control, or to relay requests in a way that circumvents their authentication, rate limits, or terms of service. The accountability for any configured upstream target rests entirely with the account that created the tunnel.

We may disable any tunnel whose configured upstream appears, at our sole discretion, to violate this section, and we may terminate the account in accordance with Section 5 (Account Suspension and Termination).

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. We disclaim all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, reliability, accuracy, and availability.

Without limiting the foregoing, we do not warrant that:

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TUNNELTO, ITS OWNERS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, REVENUE, BUSINESS OPPORTUNITIES, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, REGARDLESS OF THE CAUSE OF ACTION OR THE THEORY OF LIABILITY.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT OF FEES PAID BY YOU TO US DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM. If you are on the free plan, our maximum liability to you is zero dollars ($0).

These limitations apply even if we have been advised of the possibility of such damages and even if a limited remedy set forth herein is found to have failed its essential purpose.

You agree to indemnify, defend, and hold harmless tunnelto, its owners, employees, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to:

12. Abuse Reporting

If you believe the Service is being used in violation of these Terms or for illegal purposes, please report it to legal@tunnelto.me. We will investigate reports and take appropriate action, which may include disabling tunnels, suspending accounts, or cooperating with law enforcement.

13. Intellectual Property

The Service, including its software, design, logos, and documentation, is owned by tunnelto and protected by applicable intellectual property laws. These Terms do not grant you any right to use our trademarks, trade names, or branding without prior written consent.

14. Changes to These Terms

We may modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on the Service or by email. Your continued use of the Service after changes take effect constitutes acceptance of the modified Terms. If you do not agree with the changes, you must stop using the Service and close your account.

15. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of the Province of British Columbia, Canada, without regard to its conflict of laws principles. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration or in the courts located in British Columbia, Canada, at our election. You irrevocably submit to the exclusive jurisdiction of the courts of British Columbia, Canada. You agree to waive any right to participate in a class action lawsuit or class-wide arbitration.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and tunnelto regarding the Service and supersede all prior agreements, communications, and understandings.
